Many dead in India train fire

At least five people were killed when a train caught fire in southern India on Monday, the railways ministry said, adding the toll was likely to rise with some reports already putting it at 25.

"So far we have five confirmed dead, but we fear the number will go up significantly," railways ministry spokeswoman Chandralekha Mukherjee told AFP. "Rescuers are struggling to get inside the train to extricate people."

The accident, on a long-distance train heading from New Delhi to the southern city of Chennai, occurred in the early hours of the morning near the town of Nellore in Andhra Pradesh state.

"We are unable to identify the cause of the fire yet -- it might have been a short circuit, it might have been due to someone carrying inflammable materials on the train," Mukherjee told AFP.

NDTV television, citing a local railways official, reported that 25 people had died with an unspecified number of other passengers injured. It said the the cause was most likely to be an electrical short circuit.

Next-generation sequencing provides key in finding gene

(SALT LAKE CITY)Alternating hemiplegia of childhood (AHC) is a rare disorder that usually begins in infancy, with intermittent episodes of paralysis and stiffness, first affecting one side of the body, then the other. Symptoms mysteriously appear and disappear, again and again, and affected children often experience dozens of episodes per week. As they get older, children fall progressively behind their peers in both intellectual abilities and motor skills, and more than half develop epilepsy. Unfortunately, medications that work for epilepsy have been unsuccessful in controlling the recurrent attacks of paralysis, leaving parents and physicians with few options, and significantly disabling those affected.

Researchers at the University of Utah Departments of Neurology and Human Genetics, in collaboration with researchers at Duke University Medical Center, have discovered that mutations in the ATP1A3 gene cause the disease in the majority of patients with a diagnosis of AHC. The study was published online on Sunday, July 29, 2012, in Nature Genetics.

In a collaborative effort with the AHC Foundation, Kathryn J. Swoboda, M.D., co-first author on the study, associate professor of neurology and pediatrics, and director of the Pediatric Motor Disorders Research Program at the University of Utah, established an international database of patients with AHC from around the world, starting with a single family nearly 14 years ago. This database now includes 200 affected individuals from more than a dozen countries. Access to clinical information and DNA samples from this database were critical to the success of the international collaboration that helped to identify the first gene causing AHC in a significant percentage of patients.

"AHC is almost always a sporadic disease, which means that there is no family history of the disorder," says Tara Newcomb, genetic counselor, University of Utah Department of Neurology, and a co-author of the study. "The rarity of the disease and the almost exclusively sporadic inheritance made AHC an ideal candidate for next-generation sequencing."

The mysterious and intermittent nature of the neurologic symptoms, which range from unusual eye movements to seizure-like episodes, to partial and/or full body paralysis often results in a prolonged diagnostic odyssey for parents and children, according to Matthew Sweney, M.D., an instructor in the U of U Departments of Neurology and Pediatrics and an epilepsy specialist at Primary Children's Medical Center. "Families often present again and again to the emergency room, and children may undergo dozens of tests and invasive procedures," says Sweney, also a study co-author. "Often, it is only after the spells fail to respond to antiepileptic medications that the diagnosis is considered."

The ATP1A3 gene encodes one piece of a key transporter molecule that normally would move sodium and potassium ions across a channel between neurons (nerve cells) to regulate brain activity. Mutations in this gene are already known to cause another rare movement disorder, rapid onset dystonia parkinsonism, and clinical testing for mutations in this gene is readily available through a blood test. "Having a means to confirm a diagnosis more quickly, using a simple blood test, will allow us to better care for our patients and provide them opportunities for early enrollment in clinical trials," Swoboda says. "The identification of the gene provides scientists with the opportunity to identify specifically targeted and truly effective therapies."

In a broad international collaborative effort, the initial collaboration between the University of Utah and Duke investigators expanded to involve more than three dozen researchers from 13 countries. "This discovery is a testament to the power of the next-generation sequencing technologies, which are becoming increasingly available as a result of the Human Genome Project," says co-author Lynn Jorde, Ph.D., professor and chair of the U of U Department of Human Genetics. "These technologies are rapidly revolutionizing our ability to diagnose rare disorders, and provide hope for hundreds of families of children with rare disorders about which little is known and no targeted treatments currently exist."

###

Funding for the work at the University of Utah was provided by a grant from the Alternating Hemiplegia of Childhood Foundation (AHCkids.org). The Utah team also included former postdoctoral fellow Chad Huff, Ph.D., from the Department of Human Genetics, and Louis Viollet, M.D., Ph.D., and Sandra Reyna, M.D., from the Department of Neurology Pediatric Motor Disorders Research Program (https://medicine.utah.edu/neurology/research/swoboda).

Whole genome sequencing was performed in collaboration with the Institute for Systems Biology.

Personal Development Tips For Reaching Your True Potential | Arty ...

Try to make each day more excellent than the previous one. Push yourself to pursue every opportunity for improvement. If you did something pretty well yesterday, tell yourself that wasn?t enough. You need to do it really well today.

Sit down and uncover what has become the barrier between you and your goals. This seems to be hard from some people. However, when you can find out what your weaknesses are, this becomes the first step in dealing with them and, eventually, changing them. By removing just a few obstacles in your way, you will discover that your future is much more clear.

Learn the habits that successful people practice, and build them into your own life. Concentrate on practicing some vital core habits at first, and keep at it until they become second nature to you. It can take up to three weeks to acquire a new habit, so it is important to keep trying.

Learn how to get through trying situations without letting your emotions get the best of you. Develop techniques that will help you relieve stress and stay calm when difficulties arise. Take some time during your day to stop and take breaths.

Make a decision about where you want to go in life and stick with it. Not taking action to change your life just means you?ll be stuck with your current one forever. Do something about your dreams and you will see them come true.

Making improvements in your health will put you on the fast track of personal development. Everyone feels much better when they?re in good physical health. You?ll be able to think more clearly when you are healthy, and even save money since you will require less medical care. Make it your goal to improve your health.

Maintaining benevolent wishes for others can lead to an increase in the good things you bring into your own life. Make a decided effort to hope for the best in those around you. Negative feelings will be less burdensome and less depressing if you make it a practice to maintain a positive mood.

Your mind?s health depends on how healthy your body is. Have healthy meals that are full of nutrients, and be sure to exercise as much as you can. Don?t forget that a healthy body helps ensure a healthy mind.

If you have extensive personal development goals, consider enlisting the help of a therapist. There is only so much that can be done with self-help books; sometimes what is required is the expertise and personal attention that only a therapist can give. Sometimes, success happens by simply talking problems through. A psychiatrist can have a discussion with you, where a book cannot.

Learn the habits that successful people practice, and build them into your own life. Begin with a few basic habits, and work on them until they are second nature. It can take up to three weeks to acquire a new habit, so it is important to keep trying.

Establish your priorities, and then focus on them wholeheartedly. When it comes to focusing your feelings and emotions, strive to apply them to the important aspects of your life that build happiness, and do not waste them on the negative aspects that weigh you down and prevent inner peace.

A good, positive attitude goes a long way in your development as a person. Having a bad attitude can lead you to in a bad direction. Assure yourself that positivity is the only way to see constructive changes in your life.

Talking over your personal issues with someone such as a trained counselor or pastor can be an uplifting experience. These people are experienced and will know what to do in your situation. They?ll eagerly listen, analyze what?s going on and help you find enlightenment. Getting your problems out in the open with a professional should give you a much healthier outlook on your own life.

Everyone needs a sweet, salty or starchy treat sometimes. Try to do better next time, and don?t worry about that cheesecake you had last night. Today is a new day.

Exercise should be a part of everyone?s routine. There are many physical reasons for the need to exercise. Exercising stimulates your body to produce all kinds of chemicals that ultimately result in a happier, calmer you.

Making improvements in your health will put you on the fast track of personal development. Good health simply makes your whole life go better. You will feel stronger and have more control over your time and money since you won?t have as many medical expenses. You?ll often find that making one healthy choice leads to another, helping you to continue to improve your healthy lifestyle.

Refrain from elevating yourself to a position of excessive importance. Everyone is a part of the world?s puzzle. Everyone should be willing to learn as much as they can from others. Remember this and stay open for new chances to learn. It?s not possible to learn everything first hand, so increase your knowledge by soliciting information from others.

When you?re trying to improve yourself, failure can be a terrible hit to your self-esteem. Failure is just a learning experience incognito. Failure can teach you a great deal about what your strengths and your weaknesses are. So, each failure needs to be a proud moment to you, as you now have another piece to your personal puzzle.

Leaders are humble, though powerful and strict too. You should lecture, but do it softly, and keep in mind that you have to know servitude to be able to lead. A successful leader is one who demonstrates integrity and virtue as an example to others.

Use your strengths and patience to make difficult changes. Each person has their own set of skills. That is what makes our planet so great. Don?t waste time on what you are not good at, but rather keep your focus on the skills you have and use them wisely.

As you have read in the beginning of this article, part of personal development is expanding your knowledge. While it?s important to gain knowledge, you need to be able to apply what you?ve learned to your life and your goals. There are various ways you can begin to grow as a person. If you use some of these suggestions, you should begin to have a bit more faith in yourself

US women roll into Olympics quarters

The United States women's soccer team defeated Colombia 3-0 on July 28 in Group G play. Carli Lloyd, Abby Wambach and Megan Rapinoe scored for the U.S.

United States vs Colombia, Group G

GLASGOW, Scotland (AP) ? Abby Wambach's second-half goal put her atop the all-time list Saturday as the Americans dominated feisty Colombia 3-0, guaranteeing a spot in the quarterfinals of the London Games soccer tournament.

Megan Rapinoe scored in the first half and celebrated by wishing injured teammate Ali Krieger a happy birthday, and Carli Lloyd had a late goal in her return to the starting lineup.

But niceties were otherwise few and far between in a game that included 30 fouls ? with no altercation more painful than when Lady Andrade hit Wambach in the face in the 39th minute.

"I'm running toward the goal to get position, and I got sucker-punched," said Wambach, sporting a black semicircle under her swollen right eye after the game. "It's clear. We have it on film, so it's up to the Olympic committee and FIFA to decide what to do."

Wambach said Andrade kept on taunting in the second half and attempted another blow to the face ? but missed and hit Wambach's neck instead. When Wambach scored in the 74th minute to make the score 2-0, the achievement felt particularly sweet.

"Absolutely. It's interesting ? you think about yourself and what you would do on the street if somebody were to sucker-punch you," Wambach said. "And you have all of the lists of things that you would probably do to retaliate, but this is Olympics and I can't risk getting a red card, I can't risk getting a yellow card. We like to call it 'ice' ? stay ice cold. They're trying to get me to retaliate, and I'm proud of myself for not doing that."

Andrade called the play an accident.

"Nothing happened," she said through an interpreter. "It was just a normal part of the game. We were both running, she ran across me and we collided. I had my hands in the air. It was an accident."

Told that Wambach wants Andrade disciplined by the governing bodies, the Colombian said: "I think they should be, too, because they're the United States. The whistle always goes in their favor. They were hitting us and hitting us, but there was never a whistle."

Wambach looked like her younger self on her goal, sliding onto Tobin Heath's pass to beat two defenders. The 32-year-old striker joked that she was using her "blazing speed."

"Nobody puts balls to me like that anymore," Wambach said. "And she put it through. And I'm like, 'I've got to get there.'"

It was Wambach's sixth Olympic goal, moving her past Mia Hamm and Tiffeny Milbrett, an especially notable achievement given that Wambach missed the 2008 Games with a broken leg. It was also her second score of the tournament and her 140th career international goal, within striking range of Hamm's world record of 158.

The Americans didn't have the early defensive letdowns that they had against France in a 4-2 win three days earlier, but coach Pia Sundhage and the players weren't happy with a first half in which they just couldn't find a rhythm.

"It wasn't the prettiest game," goalkeeper Hope Solo said. "We needed that second goal. The speed of play was a little bit slow."

Rapinoe's goal came in the 33rd minute, a play set up when Alex Morgan intercepted a pass near the Colombia box. Morgan passed to Rapinoe, whose curling 20-yarder sailed over goalkeeper Sandra Sepulveda's outstretched hand.

Lloyd scored for the second time in two games as she started in place of Shannon Boxx. Boxx injured her right hamstring in the win over France and remains day-to-day.

The U.S. has one group game remaining against North Korea in Manchester on Tuesday, a match that will help determine the semifinal pairings. Colombia wraps up with France in Newcastle on the same day.

Education of Business Online from NCSU 5 Internet Marketing Tips ...

If you are looking to start your own internet marketing business then you really need to do some research before you let yourself into the amazing world of online marketing. It is an incredibly diverse and productive way to run a business, but also so easy to get caught in the many pitfalls that accompany this industry.

Here are a few internet marketing tips that will help avoid these pitfalls and get you started in the lucrative world of internet marketing:

1. Don?t get weighed down with too much information. This is the most common mistake that anyone new to internet marketing makes, and it is very easy to do. You will get bombarded with so much information that you will jump from one project to another and never get anything finished, thus you won?t make any money. Choose a project you want to work on such as article marketing and see it through until you start making some money.

2.

Choose your niche carefully. It is always good to try and market something you are passionate about and have a lot of knowledge in, but if that happens to be something like training your dog to sing (quite an extreme example, but hope you get the idea), then you aren?t going to find many people to buy that product. Look for a niche that people are actively seeking information on, and then give them something they want.

3. Don?t buy every product you see. Again, once you start getting onto different internet marketers mailing lists you will start receiving a lot of promotions for products that will promise you overnight riches. Don?t get lured in by the power of the sales page (it?s easy to do!). Take a step back and really evaluate whether a particular product will benefit your new business right there and then.

If it won?t then don?t buy it. You can always go back and purchase it at a later date if you then decide you do need it. You don?t want to get into the habit of spending more money than you?re earning, which is so easy to do at the beginning.

4. If you see a product you do like and you think it can help you at that time, but you?re not sure if you want to part with your hard earned money, then look for reviews on that particular product before you buy. Just do a Google search and see what people who have already bought the product have to say about it. This is a great way to really find out if it does what it says it does on the sales page, and can help you make an ultimate decision whether to buy or not.

5. Start building a list as soon as you can. A list is a group of names and email addresses that you will have stored so you can send them more emails to provide them with information and products they may want to buy. A list is the most important aspect of any internet marketers business so start trying to build one as early as possible.

These are just a few internet marketing tips to help you get started and to avoid some of the common mistakes that many have made before you.

Vidyo Announces New Cloud-Based Video Conferencing Service ...

vidyo

HACKENSACK?Video telecom provider, Vidyo, announced on Monday the availability of its new cloud-based video conferencing program ? simplified, high-quality andcompatible with a wide range of programs and smart phones, highlighting previous inefficiencies with the video conferencing market.

The program, Vidyoway, targets the problems with traditional video conferencing: low quality, exorbitant costs and complexity behind video conferencing programs.

The company?s mantra, ?technology should be invisible,? along with the limited availability of quality programs and high associated costs inhibiting the video conferencing market, drove Vidyo to develop its free cloud-based conferencing program.

The program offers a stronger B2B, B2C and C2C connection. Its nonexistent cost, higher quality feed and compatibility with devices makes it a solid investment for companies and consumers.

?[Our] video conferencing participants can now use a single dialing scheme to leverage video communications with other business users regardless of their device,? said Ofer Shapiro, Vidyo?s CEO and cofounder in his blog post about his company?s new product.

Shapiro went on to discuss how interoperability didn?t essentially mean interconnectivity; users may have the devices needed to collaborate on certain projects, but it does not ensure that they will be fluidly interconnected with each other.

Users are able to access a given conference with a user name and PIN code through mobile products, Microsoft Lync, H.323 Endpoint, Cisco, Polycom and SIP based rooms.

It streamlines stored information in devices to create a customized video conference. The online demo illustrates how an iPad user can create a video conference and invite its participants through its stored address book.

?Vidyo continues to prove themselves as a leader in market innovation, technical excellence, scalability and adaptability to varied video conferencing environments. The new, free Vidyoway service is sure to positively disrupt the market as Vidyo has been able to do in recent years. Vidyoway has the true potential to expand the video conferencing and collaboration market to mass deployment levels,? said Roopam Jain, Frost and Sullivan?s Industry Director of Unified Communications and Collaboration.

Vidyo has expanded their portfolio to incorporate vibrant changes in conferencing infrastructure and endpoints while broadening their scope within small and mid-sized enterprises and extending their reach within education, government, healthcare and broadcast television fields.

Syria resurrects 'mother of all' catchphrase

It's the mother of all catchphrases.

A Syrian newspaper on Saturday used a banner headline to proclaim a high-stakes fight for the city of Aleppo in the country's 17-month-old uprising "the mother of all battles."

Iraqi president Saddam Hussein famously invoked the same phrase at the beginning of the Gulf War: "The battle in which you are locked today is the mother of all battles," he told the nation in January 1991, days before a deadline to pull out of Kuwait or face U.S. action. The Arabic translation recalls a seventh-century victory by an Arab army over the Sassanian Persians, seen as an ultimate battle.

But Saddam sent "mother of all" into the '90s lexicon, as politicians, TV hosts and headline writers used it as a superlative for everything from parades to Johnny Carson monologues.

Then-Defense Secretary Dick Cheney mocked Iraqi's performance against U.S. forces in the Gulf War, declaring, "the mother of all battles has turned into the mother of all retreats." The media began to refer to Desert Storm commander Gen. H. Norman Schwarzkopf's televised updates as "the mother of all briefings."

"The mother of all parades," ''the mother of all parties," ''mother of all games" followed. Johnny Carson opened his late-night show with a promise of "the mother of all monologues."

The phrase cropped up in wartime again months before the 2003 Iraq war, when the U.S. tested a 21,000-pound called Massive Ordnance Air Blast (MOAB) ? the Mother of All Bombs.

And over the years:

? Mother of all was resurrected to describe 2008's massive financial meltdown and bank bailouts that followed.

"This is the mother of all bailouts, and we don't see the end in it yet," said U.S. Sen. Richard Shelby, R-Ala.

? Former Pakistan President Pervez Musharraf last year said he would consider running again in 2013, in "the mother of all elections."

? In 2010, a lawyer for environmentalists and injured workers seeking to sue BP over the Gulf oil spill predicted: "This will be the mother of all liability claims."

? A CBS sitcom in development a few years ago was to showcase the life of blogger and Twitter star Kelly Oxford. Produced by actress Jessica Alba, the show was titled, "The Mother of All Something."

Saddam did not invent the mother of all. The phrase appears in the King James version of the Bible to refer to both Jerusalem and Eve. And inventor-founding father Benjamin Franklin used it to raise gluttony to new levels, in an entry in Poor Richard's Almanac in 1755.

"A full belly," Franklin wrote, "is the mother of all evil."

The QualityStocks Daily Blog for Micro-cap and Small-Cap ...

ATA, a prominent supplier of computer-based testing and testing-related services in China, announced yesterday that in 2012 it will be the service provider of the National Unified Certified Public Accountants (CPA) Exam for the Chinese Institute of Certified Public Accountants (CICPA).

For over 20 years the CPA exam has been administered in China, and as a result of its impressive credibility and high standard, it is one of the most highly regarded national exams in all of China. Last year, over 1.3 million CPA exams were given in China, with more than 550,000 test takers signing up for the professional session and about 7,000 registering for the comprehensive session. Administered in more than 10,000 test centers in China, about 400,000 tests were given in the single largest CPA exam subject. Due to the expanding impact of the CPA exam, the CICPA is making every possible effort to guarantee that the exam is administered fairly and securely.

The national unified CPA exam is a method of CPA selection found only in China. The CPA Examination Committee, overseen by the Ministry of Finance of the People?s Republic of China, is solely responsible for the organization of the testing process, while the testing office of the CICPA is responsible for the execution of the CPA exam.

The CICPA believes administering the national unified CPA exam using a computer-based platform is a significant step forward for the ?CPA Examination Policy Reform Program,? which aims to enhance examination quality and organization.

Mr. Kevin Ma, ATA?s Chairman and Chief Executive Officer, stated, ?ATA?s proprietary, scalable test delivery technologies provide our clients with large-scale testing capabilities that are stable, secure and efficient. Opening Ceremony London 2012: Did director take shot at US on health care?

The director of the opening ceremony for the London 2012 Games created a production for the 99 percent, it seems. For an Olympic movement that hates controversy, that is unusual.

By Mark Sappenfield,?Staff writer / July 28, 2012

Of all the things to laud in Britain's long history, the director of the opening ceremonies for the London Olympics chose for his second act ... universal health care.?

Yes, that "NHS" spelled out by hospital beds in Friday's opening ceremonies stands for Britain's National Health Service ? the government-run universal health-care system that director Danny Boyle called an "amazing thing to celebrate."

Bob Costas, you're not in Kansas anymore.?

It is more than a little bit presumptuous to imagine that Mr. Boyle was sending coded political messages to American voters who can't here the words "universal" and "health care" in the same sentence without invoking the Commerce Clause. But that doesn't mean Boyle didn't have a message.

He insisted that message was not political, but rather a reflection of the values that British society holds dear and emanates to the world.?

"One of the reasons we put the NHS in the show is that everyone is aware of how important the NHS is to everybody in this country," he said at a press conference earlier in the day.?"One of the core values of our society is that it doesn't matter who you are, you will get treated the same in terms of health care."

But not everyone agreed that the message had no hint of politics.?"NHS beds dominated the infield for so long that it seemed more a political message than a tribute to our hardworking nurses," wrote the Daily Mail, adding that the spectacle "at times bordered on left-wing propaganda."

Repeatedly, Boyle made it clear that the ceremonies were his vision, and that London organizers gave him enormous?freedom to shape them in his image. In that case, it should hardly be surprising that the director of films that chronicled heroin users ("Trainspotting") and the Indian underclass ("Slumdog Millionaire") might craft a performance from a working-class perspective.?

Is that political? That is in the eye of the beholder.?

But it is hard to escape at least some small sense of advocacy in Boyle's second act, particularly after a cigar-chomping elite?let loose the gluttony of unchecked industry on the idyllic English countryside in the first act.?This was, it seemed, an opening ceremony for the 99 percent.?

In some respects, that gave it a poignancy beyond opening ceremonies of Olympic past ? Boyle actually had a cutting message, whatever you thought of it. But for an Olympic movement that has long avoided even the scent of controversy ? even forcing cities to ban civic protests during the Games ? it was an unusual departure.

In The Public Domain: Available And Free ? For All

While not an official, legal symbol, the copyright symbol with a line through it has become the generally accepted way to indicate that a work is in the public domain. It is usually accompanied by one of the following two statements:

1. This image has been released into the public domain by the copyright holder, its copyright has expired, or it is ineligible for copyright. This applies worldwide.

2. I, the creator of this work, hereby release it into the public domain. This applies worldwide. In case this is not legally possible, I grant anyone the right to use this work for any purpose, without any conditions, unless such conditions are required by law.

When copyright or other intellectual property restrictions expire, works will enter the public domain and may be used by anyone.
More specifically, the public domain comprises the body of knowledge and innovation, especially creative works such as writing, art, music, and inventions, in relation to which no person or other legal entity can
of the common cultural and intellectual heritage of humanity, which in general anyone may use or exploit.

Imagine The Possibilities

Can you imagine having a nearly unlimited, free source of
completed information which you can use to enhance your bright idea?

What if you could simply tap into that source and create
products which you can resell and turn into a
profitable stream of income?
When you know how to tap into the
public domain, all of this is possible.

Works created before the advent of intellectual property laws are part of the public domain. The Bible and Qu?ran, the works of William Shakespeare and Ludwig van Beethoven and the inventions of Archimedes entered the public domain long ago. However, intellectual property rights may exist in translations or new formulations of these works.

In addition, works of the United States government are excluded from copyright law and may therefore be considered to be in the public domain. For example, works created by a U.S. government agency become part of the public domain at the moment of creation. Other examples include: NASA photographs, military journalism, federal court opinions (but not necessarily state court opinions), congressional committee reports, census data, and the U.S. government website. Availability of such documents may, however, be limited by secrecy laws.

In the United States, all copyrights and patents have a finite term; when this term expires, the work or invention is released into the public domain. For example, patents expire 20 years after they are filed. However, a trademark registration may be renewed and remain in force indefinitely provided the trademark is used, but could otherwise become generic. Copyrights are more complex; generally, they expire in all countries when a variety of specific conditions are satisfied.

Before 1978, unpublished works were not covered by the federal copyright act. This does not mean that the works were in the public domain; it means that they were covered under state copyright acts. Websites that claim that ?pre-1923 works are safe? are wrong. These works, now under federal copyright, will not expire for several more decades.

Patents

Publishing the details of an invention before applying for a patent will generally place an invention in the public domain and prevent its subsequent patenting by others. For example, when a chemistry journal publishes a formula, this prevents patenting the formula by anyone. There is an exception to this; however, in U.S. law, the rightful inventor may file a patent claim up to one year after publishing it.

Trade Secrets

If guarded properly, trade secrets never enter the public domain. For example, a business may keep a product formula like that for Coca-Cola a secret indefinitely. However, if it is disclosed to the public, the former secret enters the public domain, although the former secret may still be patented in the United States.

Trademarks

A trademark registration is renewable. A trademark owner may maintain a registration indefinitely by paying renewal fees, using the trademark and defending the registration.

However, a trademark or brand may become a generic term for a particular type of product or service if people do not use it as a trademark (i.e. as a name or graphic representation exclusively identifying that that product or service originates from a particular business).

A genericized trademark ? sometimes known as a generic trade mark, generic descriptor or proprietary eponym ? is a trademark or brand name which has become synonymous with the general or formal term for a particular type of product or service, to the extent that it often replaces this term in colloquial usage.

One famous U.S, example is ?thermos?. An interesting philosophical issue is that a manufacturer who invents an amazing breakthrough product which cannot be succinctly described in plain English (for example, a vacuum-insulated drinking flask) will inevitably find its product described by the trademark (?Thermos?). If the product continues to dominate the market, eventually the trademark will become generic (?thermos?). Other examples are: escalator, trampoline, raisin bran, linoleum, dry ice, shredded wheat, mimeograph, yo-yo, nylon, kerosene, cornflakes, cube steak, lanolin, and high octane, masonite, allen wrench, pabulum, styrofoam, and zipper.

One consequence of a trademark becoming generic is that the exclusive rights which may attach to the use or registration of the trademark can no longer be legally enforced. Genericide typically occurs over a period of time where the trademark owner does not maintain or enforce its proprietary rights (e.g. by using the mark or by pursuing infringement action).
However, genericide is not an inevitable process. In the late 1980s ?Nintendo? was becoming synonymous with home video game consoles but Nintendo was able to reverse this process through marketing campaigns. Xerox was also successful in avoiding its name becoming synonymous with the act of photocopying.

Domain Names

A domain name, which may be bought and sold, never enters public domain. If nobody owns it, it simply doesn?t exist. Top level domains, such as .com, are controlled by the Internet Corporation for Assigned Names and Numbers.

Internet Public Domain Resources

Many people are using the Internet to contribute to the public domain, or make works in the public domain more accessible to more people. For example, Project Gutenberg is coordinating the efforts of people who transcribe works in the public domain into electronic form in order to create e-book. See the Resources section of this newsletter for key links.

Taking Steps to Manage Acid Reflux Disease

(ARA) ? Acid reflux disease (ARD), also known as gastroesophageal reflux disease (GERD), affects nearly 19 million Americans, and is characterized by heartburn occurring two or more days a week despite treatment and diet changes. Susan had lived with the symptoms of ARD for years until she went to her doctor and was diagnosed.

?I was busy and younger when my heartburn symptoms first occurred,? says Susan, a retired college professor and former clinical researcher from State College, Pennsylvania, who first experienced signs of ARD years ago. ?I tried over-the-counter medications, such as antacids, which helped but not enough. I went to the doctor and he explained how acid reflux happens, and suggested that I should work to better manage my stress ? which is hard for me.?

As time went on, it became harder and harder for Susan to ignore her heartburn symptoms. She began taking steps to better manage her heartburn symptoms, making several lifestyle changes, such as sleeping while propped up and trying to maintain a healthy body weight. Susan also tried to reduce her stress through such things like walking and other exercises.

?Working with my doctor, we were able to find a treatment plan that was right for me, which included taking the medication Dexilant,? Susan says. ?I began taking Dexilant, and it helped relieve my heartburn symptoms. Each person?s experience with ARD is very personal, so the best thing to do if you have or think you might have acid reflux disease, is to speak with your doctor to find out more about the condition and what might be right for you.?

To help educate people like Susan who have ARD, Takeda Pharmaceuticals U.S.A., Inc., the makers of Dexilant (dexlansoprazole), partnered with celebrity chef Spike Mendelsohn on the ?Don?t Let it Burn? campaign to raise awareness around ARD and the importance of finding ways to manage their symptoms, including diet and lifestyle changes. Lifestyle tips, music, heartburn-friendly recipes and more can all be found on DontLetitBurn.com.

?It is very important for patients to be proactive and understand that if they experience symptoms of heartburn frequently, they should reach out to their healthcare providers to find out if what they?re experiencing is acid reflux disease, and if so, what courses of action might be possible to manage this condition,? says David A. Peura, MD, Emeritus Professor of Medicine, University of Virginia School of Medicine. ?When I work with ARD patients, we counsel diet and lifestyle modifications, but often for many patients, a medication is also needed to manage the symptoms. One treatment option I prescribe for my appropriate ARD patients is Dexilant because it can offer up to 24 hours of heartburn relief.?

To learn more, visit www.DontLetitBurn.com. You can also hear from celebrity chef Spike Mendelsohn, and get tips, helpful information and facts about acid reflux disease, including:

  • Acid reflux disease can occur in both men and women, with varying severity of the disease among patients
  • Lifestyle modifications are part of a treatment plan to help manage a patient?s acid reflux disease. Some include:
    • Avoid common trigger foods, such as fried or fatty foods, citrus foods, onions, and tomato-based foods as well as alcohol, coffee and other caffeinated drinks, chocolate, peppermint and spearmint
    • Maintain a healthy body weight
    • Eat small, frequent meals rather than large amounts of food at one time
    • Try not to wear tight-fitting clothing around your waist
    • Elevate the head of your bed 6-8 inches
    • Be smoke-free

About Dexilant (dexlansoprazole) 30 mg and 60 mg delayed release capsules

Persistent heartburn two or more days a week, despite treatment and diet changes, could be acid reflux disease (ARD). Prescription Dexilant capsules are used in adults for 4 weeks to treat heartburn related to ARD, for up to 8 weeks to heal acid-related damage to the lining of the esophagus (called erosive esophagitis or EE), and for up to 6 months to continue healing of EE and relief of heartburn. Individual results may vary. Most damage (erosions) heals in 4-8 weeks.

    Important Safety Information

Dexilant may not be right for everyone. Do not take Dexilant if you are allergic to Dexilant or any of its ingredients. Serious allergic reactions have been reported. Tell your doctor if you get any of the following symptoms with Dexilant: rash, face swelling, throat tightness, or difficulty breathing. Symptom relief does not rule out other serious stomach conditions. People who are taking multiple daily doses of proton pump inhibitor (PPI) medicines for a long period of time may have an increased risk of fractures of the hip, wrist, or spine. Low magnesium levels can happen in some people who take a PPI medicine.

The most common side effects of Dexilant were diarrhea (4.8%), stomach pain (4.0%), nausea (2.9%), common cold (1.9%), vomiting (1.6%), and gas (1.6%). Dexilant and certain other medicines can affect each other. Before taking Dexilant, tell your doctor if you are taking ampicillin, atazanavir, digoxin, iron, ketoconazole, tacrolimus, or methotrexate. If you are taking Dexilant with warfarin, you may need to be monitored because serious risks could occur. Talk to your doctor or healthcare professional. Please see accompanying Prescribing Information for Dexilant.

You are encouraged to report negative side effects of prescription drugs to the FDA. Visit www.fda.gov/medwatch or call 1-800-FDA-1088.

Sally Ride Sparks Coming Out Debate Posthumously

NEW YORK -- Pioneering astronaut Sally Ride, who relished privacy as much as she did adventure, chose an appropriately discreet manner of coming out.

At the end of an obituary that she co-wrote with her partner, Tam O'Shaughnessy, they disclosed to the world their relationship of 27 years. That was it.

As details trickled out after Ride's death on Monday, it became clear that a circle of family, friends and co-workers had long known of the same-sex relationship and embraced it. For many millions of others, who admired Ride as the first American woman in space, it was a revelation ? and it sparked a spirited discussion about privacy vs. public candor in regard to sexual orientation.

Some commentators, such as prominent gay blogger Andrew Sullivan of the Daily Beast, second-guessed Ride's decision to opt for privacy.

"She had a chance to expand people's horizons and young lesbians' hope and self-esteem, and she chose not to," he wrote. "She was the absent heroine."

Others were supportive of Ride's choices.

Episcopal Bishop Gene Robinson of New Hampshire, who in 2003 became the first openly gay bishop in the Anglican world, noted that both he and Ride were baby boomers who grew up "in a time when coming out was almost unthinkable."

Robinson is 65. Ride was 61 when she died of pancreatic cancer.

"For girls who had an interest in science and wanted to go places women had not been allowed to go, she was a tremendous role model," Robinson said Wednesday. "The fact that she chose to keep her identity as a lesbian private ? I honor that choice."

However, Robinson said he had a different standard for younger gays ? to the point of insisting that his own clergy in New Hampshire be open about their sexuality if they are gay or lesbian.

"While there is still discrimination and coming out will still have repercussions, the effect of those repercussions are vastly reduced now," Robinson said. "I believe that times have changed."

There's no question that gays and lesbians overall are coming out now at a higher rate and an earlier age than those of previous generations. According to the LGBT Movement Advancement Project, adults aged 30-54 are 16 times more likely to be closeted than those under 30.

In pop culture, the fine arts, the entertainment industry, and in some individual sports, it's now commonplace for luminaries to be out as gay or lesbian. But in many other fields, the dynamics are different.

Aside from Ride, no other astronaut of any nation has come out as gay. No active player in the four major North American pro sports leagues ? football, basketball, baseball, hockey ? has come out as gay, though some retired players have done so. Ken Mehlman came out as gay only after he completed his stint as chairman of the Republican National Committee.

Back in 2002, baseball star Mike Piazza ? then playing with the New York Mets ? rebutted rumors by holding a news conference to declare, "I'm not gay." Queen Latifah, the hip-hop star and actress, has countered comparable speculation over the years by refusing to discuss her personal life.

According to a study by the Human Rights Campaign, a national gay-rights group, 51 percent of gay, lesbian, transgender and bisexual workers hide their sexual identity to most or all of their fellow employees. Citing those findings, gay-rights activists have been pushing, so for in vain, for Congress to outlaw workplace discrimination based on sexual orientation and gender identity.

Fred Sainz, the Human Rights Campaign's vice president for communications, said his initial reaction to the revelation about Sally Ride was, "What a shame that we didn't learn this while she was alive."

"However, the fact it was acknowledged in death will be an incredibly powerful message to all Americans about the contributions of their LGBT counterparts," Sainz said. "The completeness of her life will be honored correctly."

Ride's sister, Bear Ride, a lesbian who has been active in gay-rights causes, e-mailed a supportive explanation of Ride's choice.

"She was just a private person who wanted to do things her way," she wrote. "She hated labels (including `hero')."

Carolyn Porco, a prominent planetary scientist and leader of the imaging team on NASA's Cassini mission to Saturn, met Ride many years ago when she was an astronaut candidate, already steeped in the NASA mindset of reserve and self-effacement.

"Following her career all these years, she struck me as a woman of impeccable class, and it doesn't surprise she wanted to keep her private life private," Porco said. "I don't think it's anyone else's business, and I'd love for us all to get to the place where it doesn't matter anymore."

That's been a common theme in the commentary about Ride's relationship ? a hope that American society will someday reach a point where being gay or lesbian is no more noteworthy than being straight.

Sarah Blazucki, editor of Philadelphia Gay News, said that day has not arrived.

"It's still important to come out, because we're not post-gay yet," she said. "When we do have full equality, then it's a different story."

She expressed respect for Ride's choices, but also regret.

"In the long run, everyone in the LGBT community and those who will follow benefit from someone coming out," Blazucki said. "It's sad that she felt she had to wait."

Another gay journalist, widely followed blogger Bil Browning, said the revelation about Ride left him with mixed feelings.

"I wish that she had come out while she was alive," he said. "The statement that would have been sent to young lesbians across the country would have been like Obama's election was to African-American kids."

On the other hand, he acknowledged generational differences and said Ride was entitled to her privacy.

"The activist in me thinks it's a missed opportunity," Browning said. "But she did the right thing at the end."

Some of the same issues involving privacy and openness surfaced in early July when CNN journalist Anderson Cooper, after years of reluctance to go public about his personal life, confirmed that he is gay.

Cooper wrote in an online letter that he had kept his sexual orientation private for personal and professional reasons, but eventually decided that remaining silent had given some people a mistaken impression that he was ashamed.

"I hope this doesn't mean an end to a small amount of personal space," Cooper wrote. "But I do think visibility is important, more important than preserving my reporter's shield of privacy."

Two days later, there was another revelation: fast-rising R&B star Frank Ocean announced on his Tumblr page that his first love was a man.

"I don't have any secrets I need to keep anymore," Ocean wrote at the end of his post. "I feel like a free man."

Wrote Healy: '"The Normal Heart" resonated with him on a few levels: Mr. Parsons is gay and in a 10-year relationship, and working with an ensemble again onstage was like nourishment, he said."
